What Counts as Elder Abuse Under Louisiana Law?

Louisiana doesn't use a single “elder abuse” statute — instead, protection for elderly individuals (defined as age 60 or older) and persons with infirmities or disabilities is spread across a few related but distinct criminal statutes, each covering different conduct.

Cruelty

La. R.S. 14:93.3

Intentional or criminally negligent mistreatment or neglect causing unjustifiable pain, malnourishment, or suffering — the broadest and most commonly charged elder abuse statute, applying to caregivers, family members, and facility staff alike.

Exploitation

La. R.S. 14:93.4

Financial abuse — misusing an elderly or infirm person's property, assets, power of attorney, or guardianship for personal profit, including through fraud.

Simple Battery of Persons with Infirmities

La. R.S. 14:35.2

Physical battery against a victim who is incapable of consenting due to advanced age or a mental or developmental condition.

Because these are separate statutes covering different conduct, the specific charge matters — a caregiver accused of neglect faces a different statute than a family member accused of misusing a parent's bank account, even though both might be described informally as "elder abuse."

Elder Abuse Bail Bonds by Type — Penalties & Typical Bail

Louisiana elder abuse charges range from misdemeanor-level simple battery of persons with infirmities through felony cruelty and financial exploitation. The specific statute drives both the sentencing exposure and the typical bail amount.

How The Elder Abuse Bail Process Works

From arrest to release, here's what happens when you call Carter Bail Bonds for an elder abuse bond in Calcasieu Parish or the surrounding parishes.

1

Step 1: Arrest & Booking

After an elder abuse-related arrest in Calcasieu Parish, the defendant is transported to the Calcasieu Correctional Center (5410 E Broad St, Lake Charles, LA 70615 · 337-491-3800) for booking. Bail is set according to the parish bail schedule or by a judge, depending on the specific statute charged.

2

Step 2: Call Carter Bail Bonds

Call us with the defendant's full name, date of birth, and the arresting agency. If you're missing details, tell us anyway — we can often locate the record ourselves through the jail's booking system.

3

Step 3: Review Costs & Sign Paperwork

Before anything is signed, we walk you through the exact premium, payment plan options, and whether collateral applies. No hidden fees.

4

Step 4: Bond Is Posted at the Jail

Once paperwork and payment arrangements are complete, our licensed agent posts the bond directly at the facility holding the defendant.

5

Step 5: Release Processing

Jail staff process the release once the bond is posted. Release from Calcasieu Correctional Center typically happens within 2–8 hours after the bond is posted.

6

Step 6: Release & Court Requirements

After release, the defendant must attend every scheduled court date and comply with any release conditions — which frequently include no-contact orders with the alleged victim, and, for exploitation charges, restrictions on accessing the victim's financial accounts or assets. Missing court can result in a warrant, bond forfeiture, and re-arrest.

Bail Eligibility for Elder Abuse Charges

All three elder abuse statute types covered on this page — cruelty, exploitation, and battery of persons with infirmities — are typically bailable offenses in Louisiana, though conditions of release often include no-contact and financial-access restrictions.

Elder Abuse Charges Are Generally Bailable

All three charge types covered on this page — cruelty, exploitation, and battery of persons with infirmities — are typically bailable offenses in Louisiana.

When Bail May Be Increased or Restricted

  • Evidence the mistreatment was intentional and malicious (triggers the mandatory 1-year-without-benefit provision under Cruelty)
  • Ongoing access to the victim's home, care setting, or finances
  • Prior convictions involving vulnerable victims
  • Outstanding warrants or a history of failing to appear

Conditions of Release

  • No contact with the alleged victim
  • No access to the victim's residence, care facility, or financial accounts (particularly for exploitation charges)
  • Appearance at every scheduled court date
  • No new arrests while the case is pending
Important

Bail eligibility is always decided by a judge. Carter Bail Bonds does not set bail amounts or determine release — we post the bond once the court has set it.

Diversion Programs & Alternatives to Incarceration

Some elder abuse cases — particularly lower-tier, first-time charges — may qualify for pre-trial diversion, though these cases are evaluated closely given the vulnerability of the victims.

Calcasieu Parish Pre-Trial Diversion

The Calcasieu Parish District Attorney's Pre-Trial Diversion Program gives eligible defendants — particularly first-time, non-violent offenders — an alternative to prosecution. More information is available directly from the District Attorney's Office at calcasieuda.com.

Why These Cases Are Evaluated Carefully

Because elder abuse charges involve vulnerable victims, prosecutors and courts generally scrutinize diversion requests more closely than for other first-time offenses. Lower-tier charges like simple battery of persons with infirmities may be more likely to be considered than intentional and malicious cruelty or financial exploitation involving significant amounts.

Disclaimer

Diversion eligibility is determined entirely by the District Attorney's Office, not by Carter Bail Bonds. We are a licensed bail bond company — we handle release from custody, not case disposition. For questions about program eligibility, contact a Louisiana defense attorney or the Calcasieu Parish District Attorney's Office directly.
